THIS TERMS OF USE AGREEMENT (the “Agreement”) constitutes a legally binding agreement by and between DRIP Media FZCO (Drip Design), a freezone company organized under the laws of the United Arab Emirates ("Drip Design"), and the client, whether personally or on behalf of an entity (“Client”), with regard to access and use of Drip Design's website: [https://www.drip.designs.com] (the “Website”) and any other media form, channel, mobile website, or mobile application related, linked, or otherwise connected thereto. Failure to agree and adhere to all of the terms, conditions, and obligations contained herein results in the express prohibition of the Client’s use of the Website, and the Client is ordered to discontinue use immediately.

 

Thereafter the relationship between Client and Drip Design shall cease and be of no further force and effect between the parties, except that any obligation of Client to pay Drip Design for services rendered shall remain and continue to be an ongoing obligation owed by Client to Drip Design.

Service Plans
Standard Membership: Drip Design provides full-service creative support with a simple, monthly subscription. This plan includes the support of one partially dedicated designer. Updates are provided every 48-72 hours. Customers have the option to schedule a monthly call to ensure all aspects of the project are aligned with their vision. Drip Design will commence work on new requests within two business days.

Pro Membership: This plan offers fully managed projects with access to Drip Design's entire team and extended services. Progress updates are shared in writing or via Trello every 48-72 hours. Weekly calls with the Project Manager can also be arranged upon request. Drip Design commits to a response time for new service items within two business days.

All plans include ongoing support from a Project Manager to ensure project continuity and alignment with customer goals. Drip Design reserves the right to adjust, enhance, or revise these plans at its sole discretion. Customers are encouraged to review the terms regularly to stay informed of any changes.

 

Cancellation and Renewal Policy
Customers may cancel their Service Plan subscription with Drip Design by submitting a clear and unequivocal written notice at least twenty-one (21) days prior to the end of the current billing cycle. This notice period is crucial as resources, including dedicated designers and project managers, are allocated based on anticipated project continuation. Therefore, Drip Design does not offer refunds once these resources have been assigned and work has commenced.

After submitting a cancellation notice, Drip Design will continue to provide services until the end of the current billing cycle. The subscription will not be renewed, and no further charges will be incurred after the billing cycle concludes.

If a cancellation request is received without the proper 21-day notice period, the billing cycle will renew as planned, and the cancellation will take effect at the end of the next billing month.

 

There is a no refund policy.

Acceptance of Work
Drip Design provides a review period of three (3) business days following the delivery of design work for the Customer to evaluate and provide feedback. The Customer’s input is invaluable for ensuring the final product meets their expectations.

Should Drip Design not receive feedback or revision requests within the three (3) business days post-delivery, the work will be considered accepted, and the Drip Design team will move forward with the next task. This acceptance is procedural and does not prevent the Customer from providing additional feedback or requesting iterations afterward. Drip Design is committed to accommodating further refinements; however, it is understood that this will not delay the ongoing project timeline or the subscription billing cycle.

We encourage Customers to provide timely feedback to align with the project's momentum but understand that iteration is a natural part of the creative process. Drip Design is happy to continue iterating on the delivered work to ensure that the Customer's vision is fully realized, while also maintaining the

Feedback
Customer acknowledges and agrees that any questions, comments, suggestions, or other feedback related to the services provided by Drip Design ("Feedback") must be communicated through designated platforms, specifically Loom or Figma. This ensures that Feedback is properly recorded and addressed. Drip Design shall retain ownership of all Feedback and is under no obligation to keep it confidential.

Drip Design is not liable for any oversight or failure to act on Feedback that is not shared through the aforementioned designated channels. Customers are encouraged to use these platforms for all communication regarding Feedback to ensure it is duly noted and appropriately responded to.

Interruptions
There may be occasions where service interruptions occur due to factors beyond our control. These may include, but are not limited to, unforeseen circumstances such as team member unavailability, technical difficulties, or external factors impacting our ability to deliver services.

In the event of such interruptions, Drip Design shall not be liable for any loss, damage, or inconvenience caused by the Customer’s inability to receive the services during these periods. We are committed to minimizing any disruptions and will endeavor to notify Customers of any significant interruptions and resume services as promptly as possible.

Intellectual Property Rights
Unless otherwise indicated, the Website is the property of Drip Design and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics of any nature and regardless of format (herein, collectively or individually, the “Content”) and the trademarks, service marks, and logos contained there (the “Marks”) are owned and controlled by Drip Design and are protected by copyright and trademark laws and any other applicable intellectual property law or regulation of the United Arab Emirates, foreign jurisdictions, and international conventions. The Content and Marks are provided “As-Is” for your information and personal use only. Except as expressly provided herein, no part of the Website and no Content may be copied, reproduced, aggregated, republished, uploaded, posted, displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without Drip Design’s express prior written permission. Drip Design reserves all rights in the Website, Content, and Marks.

Ownership of Materials
Notwithstanding Drip Design’s ownership of Submissions, as described in Paragraph 4 (“Client Feedback”), all design and original source files created on Client’s behalf (“Projects”) belong to Client, and Client shall be the sole owner of the copyright for all Projects. In the event that any operation of law would cause Drip Design to become the owner of a Project, in whole or in part, rather than Client, Drip Design irrevocably and perpetually assigns its entire interest in the Project to Client, without limitation. Client warrants that any and all materials provided to Drip Design as examples or as material to be incorporated into a project during the design process are owned by Client and do not infringe on or misappropriate any third party’s rights, including, but not limited to, all intellectual property rights and any right of publicity. Drip Design reserves the right to share the Client's design work publicly (social media, website, etc.) unless agreed upon as stated in section 18 of this document.

Third-Party Fonts
In the event that any Project incorporates fonts that are not owned by Drip Design and require a commercial license in order for Client to legally reproduce, distribute, or publicly display the Project (“Third-Party Font(s)”), Drip Design will inform Client in writing that one or more Third-Party Fonts have been incorporated into the Project and that Client will need to purchase one or more licenses for the Third-Party Fonts from the rights-holder(s) of said Third-Party Fonts in order to legally reproduce, distribute, or publicly display the Project. Said notice will include information sufficient for Client to identify which licenses are required and who to contact in order to purchase said licenses. So long as Drip Design has informed Client of the incorporation of Third-Party Fonts as described above, Client assumes all responsibility for any consequences as a result of a failure by Client to purchase one or more licenses for any Third-Party Fonts incorporated into a Project.

While Drip Design takes reasonable measures to safeguard the data provided by the Customer during the service process, it shall not be liable for any loss, corruption, or compromise of such data. Customers are advised to maintain backups and copies of all materials provided to Drip Design. In the event of any loss or corruption of data, Drip Design will endeavor to assist in the recovery process to the best of its ability, but it cannot guarantee the restoration of lost or corrupted data.
